3. Liability
3.1 Acknowledgment
By completing the binding online registration (i.e., by submitting their personal data and payment), participants confirm that they have read, understood, and expressly accepted these General Terms and Conditions of Participation. Additionally, participants are required to sign a declaration of consent at the event check-in, which will be retained by the organizers as proof of acceptance.
3.2 Assumption of Risk
Participation in the long-distance cycling challenge is entirely at the participant's own risk. Participants are fully aware of the inherent dangers associated with cycling activities. Participants acknowledge that striving for high levels of athletic performance involves significant risks. Participants accept that the activity may pose a threat to their life and physical safety. This includes hazards for everyone participating in the long-distance cycling challenge, specifically resulting from environmental conditions, technical equipment, atmospheric influences, potential hazards of public roads, as well as natural and man-made obstacles.
Participants undertake to comply at all times with all applicable laws and regulations, in particular traffic laws.
3.3 Nature of the Event (“Unsupported”)
This event is an "unsupported" cycling challenge. This means in particular that:
- no course marshaling or route security is provided;
- no medical support is provided by the private event hosts;
- no food, water, or technical assistance is supplied along the route;
- no road closures or traffic control measures are in place;
- the event takes place on public roads.
Participants are fully and solely responsible for their own navigation, equipment, safety, supply, and emergency management at all times.
3.4 Limitation of Liability
Riding and entering the route, as well as the start, intermediate, and finish points, is done at the participant’s own risk.
To the extent permitted by law, liability of the following persons and parties is limited or excluded as set out in these Terms and Conditions:
1. Rooted Secrets, the private event hosts, helpers, volunteers, and any persons involved in the organization;
2. all other individuals or institutions involved in the organization of the long-distance cycling challenge;
3. the legal representatives and vicarious agents of all individuals and institutions mentioned in points 1 and 2.
This limitation of liability applies only to the extent permitted by applicable law and does not affect liability that cannot legally be excluded or limited.
3.5 Exceptions to the Limitation of Liability
The limitation or exclusion of liability does not apply to damages resulting from injury to life, body, or health caused by a negligent or intentional breach of duty.
It also does not apply to other damages caused by an intentional or grossly negligent breach of duty.
Any mandatory statutory liability under German law remains unaffected.
3.6 Insurance
The private event hosts do not provide any accident, health, or liability insurance for participants. Participants are solely responsible for ensuring that they have adequate insurance coverage prior to the event.
3.7 Duty to Inform
Participants are responsible for ensuring that any persons they involve privately, such as emergency contacts or helpers outside the challenge, understand that they are not part of the event organization.
3.8 Health
Participants must be healthy, in good physical condition, and thus capable of participating in Rooted Secrets. Participants are solely responsible for ensuring their own fitness. The private event hosts assume no liability for any health risks to the participants. By starting the long-distance cycling challenge, participants bindingly declare that there are no known health concerns regarding their participation.
Participants further undertake to assess their physical condition realistically and to withdraw from the event if necessary.
3.9 Impossibility of Performance
If the challenge cannot take place, or cannot take place as planned, due to circumstances beyond the control of the private event hosts, such as severe weather, official orders, route closures, force majeure, or safety concerns, the private event hosts may modify, postpone, shorten, or cancel the challenge. Further claims are excluded to the extent permitted by law.
3.10 Equipment and Clothing
The private event hosts assume no liability for the loss of participants' equipment or clothing. Participants are therefore responsible for taking appropriate care of their belongings or ensuring they have adequate insurance coverage.
Participants are further responsible for ensuring that their equipment is in a safe and roadworthy condition.
